Terms & Conditions

Bora Sailing Ibiza • Version 2 • Effective Date: June 19th 2025

By making a reservation with Bora Sailing Ibiza, the Lead Charterer confirms that all members of their group have read, understood, and agreed to the following Terms and Conditions.

1. Booking and Reservation Fee

1.1 A non-refundable reservation fee of €150 is required at the time of booking to secure your day charter.

1.2 This fee will only be refunded if Bora Sailing cancels the charter for operational reasons such as mechanical failure or unsafe weather conditions.

2. Booking Responsibilities and Special Requests

2.1 Upon receiving the Booking Confirmation and departure documents, the Lead Charterer is responsible for checking all details and notifying us immediately if anything is incorrect.

2.2 Bookings are non-transferable and cannot be assigned or sub-chartered without prior written consent from Bora Sailing Ibiza.

2.3 Special requests will be considered at the time of booking but are not guaranteed unless confirmed in writing. Additional charges may apply.

2.4 It is the passenger’s responsibility to inform us of any medical condition or special requirement (including pregnancy, reduced mobility, disabilities, chronic illnesses, or body weight over 120 kg per passenger) that may affect their experience or safety on board. Failure to disclose such information may result in denial of boarding without refund.

2.5 Medical and travel insurance are not included. All passengers must have appropriate personal coverage.

2.6 Water activities such as snorkeling or paddleboarding are optional and carried out at your own risk.

3. Cancellations and Refunds

3.1 If the customer cancels the booking for any reason, the reservation fee of €150 is non-refundable.

3.2 If Bora Sailing cancels the charter for operational reasons or unsafe weather conditions, customers will be offered an alternative date or a full refund (admin fees not included).

4. Safety and Conduct Onboard

4.1 The use of illegal substances or dangerous, disruptive behavior on board is strictly prohibited.

4.2 If any passenger is found in possession of illegal substances or behaves inappropriately (including intoxication, aggression, or disobedience to safety instructions), the captain may immediately cancel the charter without refund.

4.3 This is a marine adventure activity. Bora Sailing reserves the right to deny boarding or participation in the day charter to any passenger if the captain, at their professional discretion, deems it unsafe for the passenger, other guests, crew, or the vessel. This includes, but is not limited to: undisclosed medical conditions (e.g., cardiovascular, respiratory, neurological), advanced pregnancy, significantly reduced mobility, body weight over 120 kg (due to the use of auxiliary dinghy boats), visible intoxication, or any other condition posing a risk or hindering safety compliance. The charter will continue with remaining guests, and no refunds or compensation will be provided.

5. Risks, Liability and Force Majeure

5.1 Participation involves inherent risks such as seasickness, injuries, or accidents. You participate at your own risk.

5.2 Any water activities (snorkeling, paddleboarding, etc.) are voluntary and may involve risks. Bora Sailing is not liable for accidents, injuries, or loss of personal belongings during such activities.

5.3 Bora Sailing and its crew are not responsible for acts or omissions of other passengers or third parties.

5.4 You confirm you are physically and mentally fit to participate. You must inform Bora Sailing of any medical condition or disability that could limit your participation. Failure to do so releases us from liability.

5.5 Our maximum liability is limited to the amount paid for the day charter.

5.6 If international conventions apply (e.g., Athens Convention 1974), Bora Sailing will adhere to their liability limits.

5.7 Force Majeure: Bora Sailing is not liable for delays, cancellations, or changes caused by events beyond our control, including but not limited to pandemics, governmental restrictions, port closures, health emergencies, strikes, technical failures, or third-party service interruptions. No refunds or compensation will be provided in such cases.

5.8 By booking with Bora Sailing, you release us from any legal claims for loss, injury, or damages resulting from the inherent risks of sailing and marine activities.

6. Passenger Insurance and Responsibility

6.1 All passengers are strongly advised to have appropriate travel and health insurance.

6.2 Passengers are responsible for their own safety and that of any minors under their care at all times.

7. Governing Law and Jurisdiction

7.1 These Terms are governed by the laws of Spain.

7.2 Any disputes shall be exclusively resolved by the courts of Oviedo, Spain.
