By making a reservation with Bora Sailing Ibiza, customers acknowledge that they have read, understood, and agreed to these Terms and Conditions.

1. Booking and Reservation Fee:

1.1 To secure a reservation for our 8-hour sailing charters from Ibiza to Formentera, a reservation fee of €150 is required at the time of booking.

1.2 The reservation fee is non-refundable unless the charter is cancelled for reasons attributable to Bora Sailing, such as a boat under repair or unsafe weather conditions.

2. Customer Cancellation Policy:

If the charter is cancelled at the customer’s request, the €150 reservation fee will be retained by Bora Sailing and will not be refunded.

3. Maximum Number of Passengers:

3.1 The maximum number of passengers for our sailing charters is limited to 6 individuals.

4. Prohibition of Illegal Substances and Unsafe Activities:

4.1 The consumption of illegal substances or engagement in any other unsafe activities onboard is strictly prohibited.

4.2 Bora Sailing reserves the right to immediately cancel the trip without reimbursement to the customer if illegal substances are found or unsafe activities are observed onboard.

5. Changes to Itinerary:

5.1 Bora Sailing reserves the right to make changes to the charter itinerary or cancel the charter if unforeseen circumstances arise.

5.2 In the event of changes or cancellations by Bora Sailing, customers will be notified promptly, and alternative arrangements or a refund will be offered.

6. Limitation of Liability:

6.1 Bora Sailing and its employees shall not be liable for any loss, injury, or damage to persons or property during the charter, including but not limited to personal belongings, valuables, or equipment.

6.2 Customers participate in the charter at their own risk, and Bora Sailing shall not be held responsible for any accidents, injuries, or incidents that may occur during the trip.

6.3 In no event shall Bora Sailing’s liability exceed the total amount paid by the customer for the charter.

7. Applicable Law and Jurisdiction:

7.1 These Terms and Conditions are governed by and construed in accordance with the laws of Spain.

7.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Oviedo Courts.
